Abstract

Evropská regulace (zejména Směrnice o nekalých obchodních praktikách) nemůže uplatňovat právní požadavky ohledně vkusu a slušnosti, které se podstatně rozlišují v členských státech. Ve skutečnosti je iluzorní a nemístné uvažovat o evropské harmonizaci etických a často emocionálních hodnot. Na druhé straně soutěžitel musí být na evropském trhu chráněn proti chování jiného soutěžitele, které vede k narušení soutěže.

Abstract (in English)

European regulation (after all Unfair Commercial Practices Directive) cannot to put legal requierements about tast and decency which are very different among the Membres States. It's, as a matter of fact, illusory and out of place to think of a European harmonisation of such ethical and emotional values. On the other side the competitor should be protected on European internal market against the behaviour of another competitor distorting competition.
