Abstract

Právní normy jako všeobecně závazná pravidla chování jsou výsledkem uvědomělé činnosti zákonodárných orgánů státu. k tomu, aby právo efektivně plnilo svůj účel, bylo respektováno, využíváno a aplikováno, musí být také správně interpretováno. V oblasti interpretace má mimo jiné velký význam soudní judikatura. Interpretace a judikatura pak mohou zpětně přispět ke zkvalitnění dalšího legislativního procesu. Co je interpretace práva? Proč je osvojení si právnických znalostí a dovedností nezbytné pro kvalitní a kvalifikovanou interpretaci? Co představuje rozhodování soudů v legislativním procesu a v interpretaci? I přes rozšiřující se možnosti přístupu k informacím (právo nevyjímaje) kvalifikovaná interpretace práva a judikatura spíše nabývá na významu, a to jak v českém, tak i v evropském právním prostředí.

Abstract (in English)

The legal regulations as generally binding rules of conduct are the result of conscious activity if the state legislateve bodies. Should the law fulfil its purpose effectively, be respected, made use of and applied properly, it must be also correctly interpreted. In the fields of interpretation, it is the judgements, which is among others of a great importance. Interpretation and the practice of the courts then can contribute by return to an enhancement of the quality of the legislative process. What is interpretation of the law? Why is acquiring legal knowledge and lawyerś skills imperative for quality and professional interpretation? What meant the practice of the courts for law-making and its interpretation? Notwithstanding the expanding possibilities of an access to information (not excluding the law), the skilled interpretation of law and the practice of the courts are of growing importance in the Czech as well as in the European legal surroundings.
