Abstract

Kniha se zabývá ochranou spotřebitele v soukromém právu ČR. Klade si za cíl odpovědět na otázku, jakým způsobem je spotřebitel chráněn v právním řádu ČR a jak tato ochrana koresponduje s implementovanými normami Evropských společenství, případně s judikaturou Evropského soudního dvora. Kolizi norem ČR a práva ES se pak snaží řešit návrhy de lege ferenda tak, aby právní úprava byla v souladu s účelem a obsahem prováděných směrnic.

Abstract (in English)

The book deals with the Consumer protection in the Czech Private Law. The author aims at answering the question how a consumer is protected in the Czech Private Law and how these juridical institutes correspond to the Directives of the European Communities or to the judgments of the Court of Justice of the European Communities. Some propositions de lege ferenda are presented how potential conflicts of rules of the European Communities with the rules of the Czech Private Law could be resolved so as the legal regulation will be brought into accord with the purpose and the contents of the implemented Directives of the European Communities.
