Pravomoc ES k uzavírání mezinárodních smluv je stanovena výslovně nebo implicitně. Smlouvy ES se třetími státy jsou sjednávány podle rozdílných procedur. Účinky těchto smluv v systému komunitárního práva jsou rovněž různé.

Competence of the EC to conclude international treaties may be given expressly or implicitly. Treaties are concluded with third countries according to different procedures. The effect of such treatis in EC law also differs.
