Abstract

Autorka se zabývá otázkami ochrany zaměstnanců v případě právního převodu podniku a podnikání nebo právního převodu části podniku a části podnikání z pohledu právní úpravy v komunitárním právu a v českém pracovním právu. Nejdříve zkoumá vývoj právní úpravy ochrany zaměstnanců ve směrnicích ES a v judikatuře Evropského soudního dvora. Poté se zabývá stejným vývoj v českém pracovním právu a v judikatuře Nejvyššího soudu. Na základě této analýzy hodnotí způsob a kvalitu transpozice ES směrnic o ochraně zaměstnanců v případě právního převodu podniku v české pracovněprávní úpravě.

Abstract (in English)

The author deals with the questions of the protection of the employees in the case of the legal transfer of an undertaking and businesses or the legal transfer of a part of undertaking and a part of businesses from the point of view of the legal regulation in the EC law and in the Czech labour law. At first she examines the development of the legal regulation of the protection of the employees in the EC Directives and in the case law of the European Court of Justice. Then she deals with the same development in the Czech labour law and in the case law of the Supreme Court. On the grounds of the analysis made she evaluates the mode and quality of the transposition of the EC Directives on the protection of the employees in the case of the legal transfer of the undertaking into the Czech labour law regulation.
