Abstract

Při pořádání zážitkových kurzů je nutné kromě jejich vlastních pravidel (dramaturgie ad.) respektovat i požadavky, které pro takovou činnost stanovuje český právní řád. I při letmém pohledu se ukazuje, že jich rozhodně není málo. Ať už se jedná o problematiku nakládání s osobními údaji budoucích účastníků kurzu, dodržování hygienických norem co do hlučnosti nebo stravy účastníků, daňové předpisy, občanskoprávní odpovědnost za škodu... Bylo by možné pokračovat rozsáhlým výčtem dál. Řada těchto otázek by jistě zasluhovala hlubší zamyšlení. Pro tento příspěvek byla vybrána ta oblast práva, kterou jsou kurzy protkány v podstatě od začátku do konce a na kterou se přitom velmi často zapomíná. Je jí oblast autorskoprávní.

Abstract (in English)

The contribution deals with some questions connected to the possibility of using musical and audio-visual works during non-traditional forms of teaching, especially on courses using methods of experiential education. Czech author law allows as an exception in the exhaustive list of clauses to use the author's works without their agreement or payment for "teaching", stated in the § 31 section 1 letter c). The article explains in detail this provision with the aim of determining in what cases it is possible to use on courses musical and audio-visual works free of charge and without the author's agreement, and in what cases it is not possible. It concludes with the question of how to proceed legally as a user of author's works which do not fall into "teaching" for different reasons.
