Anotace
The Czech economy transformation rating is usually connected with an imperfect legal framework. Law is considered to be one of the limiting factors of a successful process of transformation. Its dubiousness has many causes which have gradually intertwined and cumulated. The above-mentioned development trends of the legal system can be observed in several levels: a) solution of legal conception choice problem, b) creation of legally-philosophical doctrine, c) clarification of correlations between the legal system change process and the Czech economy transformation process. Positive changes of the Czech economy legal framework are expected from the new approaches to the legal conception. The existing limitations of this legal framework are considered to be primarily: 1. signs of lacking any conception and system as well as the presence of legal insecurity, 2. revisions of original ideas about the speed of transformation legal framework changes on behalf of its long-term nature, 3. inconsistent discontinuity of the post-November (i.e., after 1989) legal system with the legal system resulting from the needs of an economy based on social proprietorship and planned management, 4. inadequate reactions of the legal system to the economic reality requirements, particularly in the area of legal regulations dealing with private proprietorship and execution of property rights, 5. slow absorption of economys theoretical resources and economic policies to the legal thinking of especially those legal institutions that for the key elements of business legal environment.
