Abstract

Čtvrtá část série o právu WTO je úzce napojena na díl předcházející, který se věnoval přímému účinku práva WTO v ES z teoretického pohledu. Tato část je zaměřena na judikaturu ESD týkající se tohoto tématu - International Fruit Company, Fediol, Nakajima, Hermes, Dior a další. Článek poskytuje čtenáři přehled argumentů vysvětlující pozici ESD. Dva velice důležité případy - Van Parys a Biret budou pojednány v příštím a zároveň posledním díle.

Abstract (in English)

This fourth volume of the series about WTO law is closely connected with the previous one which dealt with the direct effect of WTO law in ES from the theoretical point of view. This part focuses on the cases of SCJ handling with this topic as International Fruit Company, Fediol, Nakajima, Hermes and Dior, etc. It gives the reader the summary of arguments explaining the ECJ position. Two cases of high importance - Van Parys and Biret will be dealt with in the necxt (and last) volume of the series.
