Abstract
It discourses about conditions for conclusion of business contracts. De lege ferenda it proposes to conclude a contract without agreement about a whole content of the contract considered certain conditions. It also proposes conclusion of a contract of sale without an explicit agreement about the price.
Abstract (in Czech)
Příspěvek se zabývá aktuálními otázkami a perspektivami uzavírání obchodněprávních smluv v České republice. Pojednává o podmínkách pro vznik obchodněprávní smlouvy. Navrhuje pro budoucí úpravu vznik kontraktu bez dohody o celém obsahu smlouvy, a to za určitých podmínek. Navrhuje též možný vznik kupní smlouvy bez výslovné dohody o ceně.
