Abstract

Příspěvek se zabývá pravomocí Evropské unie (Evropských společenství) v oblasti ochrany základních práv. Stručně popisuje genezi ochrany základních práv v EU (obecná zásada práva Společenství) a rozebírá stanovisko Soudního dvora Evropských společenství k přístupu Společenství k Evropské Úmluvě na ochranu lidských práv a základních svobod. Příspěvek se rovněž vypořádává s pravomocemi Evropské unie ve zkoumané oblasti, které vyplývají ze zakládacích smluv.

Abstract (in English)

This paper deals with the competences of the European Union /Community in the area of fundamental rights. First, the genesis of the protection of the fundamental human rights in the EU (the general principle of European law) is briefly described. Second, the opinion of the European Court of Justice on accession of the Community to the Convention on Protection of Human Rights and Fundamental Freedoms is discussed. Further more, the paper focuses on the competences of the Union in the said area resulting from the Founding Treaties.
