Abstract
Článek ukazuje, že teritoriální stát a teritoriální právo coby symbolicky efektivní podpěry a zdroje modernizačního „plánu“ (v pojetí P. Bourdieu), prodělávají v éře sil, jež jsou bytostně transnacionální, hlubokou transformaci, která souvisí s úpadkem jejich schopnosti autorsky řídit procesy, jež mají globalizovaný charakter. Oslabení řádotvorné síly státu souvisí do značné míry s tím, že je recentní stát nucen normativně regulovat procesy, které sám do značné míry neutvářel, jeho přetrvávající normativní suverenita není dostatečně podepřena suverenitou faktickou, což vysvětluje i úbytek legitimity státu a práva v kontextu globalizované společnosti.
Abstract (in English)
This article illustrates that in the era of truly transnational powers, a territorial state and territorial law, as symbolically effective props and sources of a modernization “plan”(according to P. Bourdieu), udergo deep transformation connected to the decay of their ability to be authors and directors of processes of globalized nature. The weakening of the normative power of state depend to a large extent on that fact that the recent state is forced to normatively regulate processes that it did not create, its normative sovereignty is not sufficiently supported by factual sovereignty, which also explains the decrease in state legitimacy and of law in the context of a globalized society.
