Abstract
Příspěvek se vrací k nedávno proběhlé diskusi o účincích odstoupení od smlouvy na vlastnictví třetí osoby, která věc mezitím v dobré víře nabyla. Je poukázáno na to, že podobné otázky mohou vyvstávat i ve vztahu k jiným právním institutům než je odstoupení od smlouvy. Kritice je podroben zejména institut prohlášení o majetku. Za hlavní příčinu současné situace je pak označena nedokonalá formální publicita skutečností omezujících povinného v nakládání s jeho majetkem.
Abstract (in English)
This paper comes back to the recent discussion about the effects of withdrawal from the contract on the ownership of third party who acquired the transferred thing in the mean time. It is pointed out that similar problems can occur even by other institute, i.e. not only by withdrawal from the contract. Especially the institute of statement of property is scarified in this paper. As the basic reason of that situation is mentioned the incomplete formal publicity of those facts that restrict the right of the liable party in disposal with his/her property.
