Abstract

Text analyzuje trestněprávní aspekty Listiny základních práv EU - 2007. Srovnává daný stav s vnitrostátní úpravou a trestněprávní teorií českou. Závěr: standard evropského práva vtělený do Listiny základních práv EU - 2007 zásadně a výrazně nepřevyšuje standard vnitrostátního ústavního a trestního práva hmotného a procesního ČR. Naopak, v některých směrech je tento národní standard vyšší; např. v základu a dosahu zásady ne bis in idem.

Abstract (in English)

The text analysis the criminal aspects of the Bill of basic Rights of the EU - 2007. It does comparison of this state with national penal legislation and theory in the CR. Conclusion: standard of the european law incorporated in the Bill of basic Rights of the EU - 2007 does not go over the standard of the national substantive and process criminal and constitutional law of the CR. On the contrary, this national standard is in the some directions higher; f. e. the basic and reach of the principle ne bis in idem.
