Abstract

At times, artists seem to challenge legal rules while at the same time calling their activities “art”. When facing an accusation, they defend themselves saying: “We did not breach law because all we did was fine art.” This paper addresses the questions the judge finds herself facing when the gravity of problems reflected by the works of art may be contrasted with the gravity of the infringement of law, drawing on recent examples of works of conceptual art in the Czech Republic.

Umělci občas prostřednictvím svých uměleckých děl porušují právní normy. Když následně čelí trestnímu stíhání, hájí se tím, že neporušili právo, protože vytvořili umělecké dílo, případně, že prostřednicvím svého díla chtěli upozornit na závažná nebezpečí, se kterými se současná společnost musí potýkat. Tento příspěvek se zaměřuje na problémy, se kterými se musí vypořádat soudce, když takový případ rozhoduje na základě analýzy několika příkladů českého konceptuálního umění.
