Anotace
The purpose of this article is to analyze the possibilities of expert witness activity throughout the private law in the Czech Republic. Juridical institute of expert witnesses and court interpreters are under Expert Witnesses and Court Interpreters Act No. 36/1967, Coll in the Czech Republic. Expert witnesses are able to provide their activity only for needs of public agencies and/or for needs of natural person and legal person within the interaction with public agencies. Any other activity is under Civil Code and Trade Code. There is huge imbalance between demand and supply of expert witness services in public and private sector considering provisions laid down by law. There is a demand overhang for services of expert witness in public sector. This status markedly impact quality of experts report. Beyond the private sector there is a surplus of provided services. Further, the article deals with elemental changes in legal regulation of expert witness activity and their impact to private law relationship.
