Abstract

Autorka příspěvku se věnuje otázce právního postavení otroků v antickém Římě, jakož i v některých dalších tehdejších státech. V minulých letech konference prezentovala autorka příspěvky souvisejícími s otázkou autonomie vůle v římském systému, jakož i s otázkou srovnání právního postavení římského otroka s otrokem starověkého Řecka. Předkládaný příspěvek se zabývá problematikou diskriminace v římském právu a ochranou slabší strany právního vztahu jako kompenzace právní nerovnosti určitých skupin. Příspěvek vznikl v rámci vědecko - výzkumné činnosti autorky v postgraduálním studiu.

Abstract (in English)

The author of this paper implements her research in the field of the legal position of the slaves in the ancient Rome and in some other ancient states. In the previous years of the conference she presented contribution concerned with autonomy of the will and the comparation of the legal position of the Rome and Greek slave. This paper deals with the problem of discrimination as well as with the protection of weaker party as demonstration of law-unequal compensation. One of the previous papers enlarged the topic of discrimination in Roman law, this paper concentrates on the questions connected to the law protection of disadvantaged groups.The paper represents a readout of the research which was carried out in the course of doctoral study (Ph.D. study programme).
