Abstract

Pokud zadavatelé postupovali při zadávání zakázek v souladu se stanoviskem ÚOHS, nelze po nich žádat, aby posoudili právní úpravu správněji než ÚOHS, neplatnost tedy nemohli předvídat a za škodu by tedy neměli odpovídat. Jestliže by byl učiněn závěr, že nesprávnost stanoviska úřadu předvídat mohli, pak je mohla předvídat i druhé smluvní strana a tato strana tedy po zadavateli škodu uplatňovat nemůže.

Abstract (in English)

If public procurement submiters acted conformable with the standpoint of the Office for the protection of competition, it is impossible to request them to judge law more rightly then Office for the protection of competition has done. They could not foresee invalidity and they should not account for the damage. If there is a conclusion that they could foresee incorrectness, then also the adverse party could foresee this fact and this party is not allowed to claim the damage after submiter
