Abstract

Smyslem tohoto krátkého článku bylo poukázat na pluralitu zdrojů úpravy a jejich vzájemné prolínání se. Nikoli detailně analyzovat jejich ustanovení. Snad i více než v jiných oblastech je důležité vnímat vzájemné vazby a možnosti, které nám jednotlivé zdroje právní úpravy dávají. Vnímat rozdíly mezi volbou práva a inkorporací normy, vnímat rozdíly mezi volbou práva a autonomií hmotněprávní, chápat vzájemné aplikační vazby.

Abstract (in English)

The sphere of the law applicable for contracts is typical by both legal pluralism and plurality of methods of legal regulation. The confused and academically blurred situation is further complicated by factors such as varied applicatin of law (the law v. the facts being proved; application of foreign law ex offo v. application based on a party s proposal ets.) dependence of a number of issues on the determined forum and eventually by an agredd way of dispute solution. The autohor analyses individuel sources of legal regulation of across the border contracst. She also deals with various methods serving to regulation by the CISG, and conflict of laws.
