Abstract

Stať představuje dílčí výsledky projektu „Věková hranice trestní odpovědnosti a kriminalita mládeže“, který byl v roce 2010 uskutečněn Katedrou trestního práva Právnické fakulty Masarykovy univerzity. Jde o kriminologický výzkum, jehož cílem bylo zjistit názor soudců a státních zástupců na otázky věkové hranice trestní odpovědnosti, jakož i na další významné aspekty související s fenoménem kriminality mládeže. Podrobněji byly zkoumány příčiny kriminality mládeže, aktuální sociálně patologické jevy ohrožující děti a mladistvé. Analýze byly podrobeny stěžejní aspekty platné právní úpravy, jak vyplývají ze zákona č. 218/2003 Sb., o soudnictví ve věcech mládeže. Dále byly zjišťovány názory na povahu sankcí ukládaných dětem a mladistvým, jakož i na zkušenosti s jejich výkonem. Pozornost byla rovněž upřena k názorům na potřebu zvláštní ochrany dětí a mladistvých v řízení vedeném proti nim.

Abstract (in English)

The text presents some part-outcomes of the project called “Age-limit of the criminal liability and the juvenile delinquency” which was realized by the Department of Criminal Law of the Faculty of Law (Masaryk University) in the year 2010. It is a criminological survey which aim was to find out the attitude of the judges and public prosecutors to the issue mentioned above as well as to some other important aspects regarding to the phenomenon of the juvenile delinquency. In more detail the causes of the juvenile delinquency and the actual socially pathologic phenomenon endangering children and juveniles are focused on. Key aspects of the current legal regulation (law No. 218/2003 Coll., on judiciary in the juvenile matters) were analyzed. The attitudes towards the nature of the sanctions imposed upon children and juveniles were gathered as well as the experience in its execution. The authors also concentrated on the attitudes to the need for some particular protection of children and juveniles within the procedure conducted against them.
