Abstract

Text se zabývá právy hlavy státu v oblasti zastupování státu navenek a přijímání a jmenování vyslanců s výjimkou sjednávání a ratifikace mezinárodních smluv. Článek vychází z toho, že prezidentova práva v této oblasti jsou dána Ústavou. Ústava stejná práva nesvěřuje nikomu jinému, proto je zde postavení prezidenta významné. I když jde o kontrasignované pravomoci, což předpokládá součinnost premiéra, nemůže si je výlučně přivlastnit premiér ani vláda proti vůli prezidenta. Článek se věnuje speciálně ústavně neupravenému vyhlášení války a považuje tento akt za právo prezidenta v rámci jeho obecné působnosti zastupovat stát navenek. Vyhlášení válečního stavu Parlamentem je totiž akt vnitrostátního práva, který je předpokladem pro následné vyhlášení války prezidentem, ale sám o sobě není vyhlášením války. Dále se text věnuje uznání státu, kde je současná praxe uznání nového státu vládou hodnocena jako neústavní zásah do práv prezidenta republiky v rámci zastupování státu navenek. V závěrečné části věnované přijímání a jmenování vyslanců se na základě historické komparace kritizuje dnešní ústavní text, který obecně hovoří o vedoucích zastupitelských misí, když prezident jmenuje jen vedoucí diplomatických misí 1. a 2. třídy – velvyslance a vyslance, nikoliv vedoucí diplomatických misí 3. třídy ani vedoucí konzulárních úřadů.

Abstract (in English)

The text concerns with the rights of the head of state in a field of representing the state outwardly, with the exception of negotiation and ratification of international agreements. The text works on the presumptiont that the Constitution provides the president with rights in this field. But the Constitution does not give the same rights to anyone else, that is why position of the president is very special. These authorities are counter-signed by the prime minister, but they cannot be usurped exclusively neither by prime minister nor by government against the will of president. The text concerns especially with declaration of war, which is not regulated by the Constitution, and the text considers this act as the right of the president. In fact, declaration of war by the Parlament is the act of internal law, which is the precondition for subsequent declaration of war by president. The text concerns also with recognition of state, it considers the contemporary practice of recognition of new states by government as unconstitutional encroachment on the rights of president. The last part concerning receiving and appointing of the envoys criticizes contemporary constitutional text on the base of historical comparison.
