Abstract

The legislation of the Czech Republic regulating employment and fight against unemployment is based on international standards adopted by international organisations dealing with human rights or engaging in the field of labour law and social security. The present paper deals with international instruments concerning social protection of unemployment, in particular social security and unemployment benefits, adopted by international law with respect to implementation of these instruments in the Czech law. It analyses the impact of standards contained in conventions of the International Labour Organisation and treaties of the Council of Europe that were ratified by the Czech Republic on the national legislation.

Legislativa České republiky, která upravuje zaměstnanost a boj proti nezaměstnanosti, je založena na mezinárodních standardech přijatých mezinárodními organizacemi, jež se zabývají lidskými právy nebo působí v oblasti pracovního práva a sociálního zabezpečení. Příspěvek se zabývá nástroji, které se týkají sociální ochrany nezaměstnaných, zejména sociálním zabezpečením a dávkami v nezaměstnanosti přijatými mezinárodním právem ve vztahu k jejich implementaci do českého právního řádu. Rozebírá vliv standardů, jež jsou předmětem úmluv Mezinárodní organizace práce a úmluv Rady Evropy, které Česká republika ratifikovala, na vnitrostátní zákonodárství
