Ve své kapitole autor pojednává o právu na spravedlivý proces a z něho vyplývajícím právu na tlumočení a překlad v trestním řízení. Zmiňuje taktéž novou směrnice Evropského parlamentu a Rady o právu na tlumočení a překlad v trestním řízení z 20.10.2010. Věnuje se tomu, jak je uvedené právo upraveno v české vnitrostátní právní úpravě. Provádí rozbor této právní úpravy a poukazuje zejména na skutečnost, že závazky vyplývající ze směrnice není stávající právní úprava schopna zajistit. V té souvislosti se zamýšlí nad vývojem legislativních návrhů týkajících se postavení tlumočníků, které by podstatně mohly přispět k zajištění závazků vyplývajících ze směrnice. Poukazuje i nato, jak lze právo na tlumočení a překlad zneužít ke způsobení průtahů v trestním řízení.
