Il existe une disparité patente entre, d´une part, les exigences resultant du principe de non-invocabilité du droit interne (I´article 27 de Ia Convention sur Ia droit des traites), en cc compris Ia supériorité du droit international, telles qua détinies par Ia CPu et reprises par Ia jurisprudence internationale plus récente, at. d´autre part, de nombreuses pratiques législatives ou constitutionnelles ainsi qua des jurisprudences nationales, qui ignorent ces exigences, voile les contredisent. II ne Existe una evidente discrepancia entre, par un ado, las exigencias derivadas del principlo de Ia no invocabilidad del derecho interno (Convencion sabre el Derecho de los Tratados, articulo 27), incluyendo Ia superioridad del derecho internacional, tales coma definidas por Ia CPu y utilizadas por Ia jurisprudencia intemacional más reciente. y, en segundo lugar, muchas prácticas legislativas o constitucionales asi como Ia jurisprudencia nacionat, que ignoran estos requisites o incluse que los contradicen. No se trata tampoco de un fenomeno temporal. La práctica generalizada de los Estados que consiste en Ia adaptación del derecho internacional en el derecho interno mediante un acto unilateral de recepcion, ha Ilevado a “domesticar” el derecho internacional. Esta tendencia hacia Ia dnmesticación está creciendo. Por una parte, desemboca en Ia amputación del principio de no invocabilidad de su “p150 constitucional”. Poratm parte, Ia competencia para organizar los rnedios de aplicacion de las obligaciones internacionales se entiende a menudo, coma un poder soberano, que escapa totalmente a las obligaciones impuestas sobre Ia base de los articulos 26 v 27 de Ia Convention de Viena.

There is an obvious dissonance between, on the one hand, the requirements imposed by the principle of non-invocability of municipal law (Article 27 of the Convention on the Law of Treaties), including also the supremacy of international law, as laid down by the PCIJ and further set out by the more recent international case-law, and, on the other, the numerous legislative or constitutional practices as well as municipal case-law, which ignore those requirements or even challenge them. That is not a temporal, transient phenomenon: the wide-spread States' practice of introducing international law into their municipal law by unilateral acts of reception has resulted into a „domestication” of international law. That tendency has two consequences: first, it “amputates” the principle of non-invocability from its effects on the constitutional level. Second, the power to organize for the means of performing international obligations is often understood as a sovereign power, exercised entirely outside the obligations imposed on the basis of Articles 26 and 27 of the Vienna Convention. That practice undermines the ability of international law to coordinate effectively cooperation between States. This article suggests to rebalance both legal systems: instead of rehearsing and recycling the ancient theories of its supremacy, international law and its institutions, in particular the ILC and the ICJ ought to take the initiative of demonstrating the gravity of the situation to the States and providing them with clear and convincing answers to the present uncertainties.
