These thesis with a title „Weaker Contracting Party’s and Third
Parties‘ Rights Protection within the Context of Modification
of Rights in Property Originated in Marriage“ deal with
examination of legal regulations concerning weaker contracting
party’s and third parties‘ rights protection in connection with
modifications of statutory marital property regimes between
spouses in Europe and subsequently in the Czech Republic. As
the draft of the new Civil Code is based not only on the Czech
tradition, but also on the existing civil codes of continental
Europe, the first part of these Thesis deals with the European
basic model systems with respect not only to basic property
regimes but also to possibility to modify the basic statutory
regime, in both cases in connection with theme of these Thesis.
The second part of these Thesis deals with the question of the
legal regulation de lege lata in the Czech Republic.
Considering regulations de lege ferenda I focused on
prospective legal regulation that is currently being prepared
by means of the draft of the new Civil Code.
