Course objectives
The main aim of the cources may be characterised as obtaining the knowledge and skills from family law as a basic branche of private law. Lectures are focused on statuse and property law issues. The students are tought to search, study, analyze and comment the case law of the Constitutional court and the European court of Human Rights to be able to understand human rights dimension of family law. Students are motivated to study foreign legal orders to understand the process of convergence and divergence of family laws in Europe, their roots. By getting known the "common core" and by trying to find "better law" the students understands developtment and perspectives. The cources are focused - beside other activities - on analysing case studies, solving model cases, interpretation, aplication, discussion, argumentation.

  • Family law: purpose, aim and place in system of laws. Divorce. Models of divorce in Europe: quilty, breakdown, contract. History. Convergence and Divergence. Perpectives. CEFL. Principles. Recodification of family law. Europaisation of family law.

Assessment methods
The cours is based on lectures and practical seminars (workshops), which are obligatory. The key condition for obtaining the credits is active participation on presentations and class discussion on practical cases, model cases and case studies based on decisions of the Constitutional Court and the European Court of Human Rights, including the disent oppinions. The home individual study of law, cases, literature and PowePoint presentations is - beside the attendance at lectures - precondition. Students have to present home written preparation during workshops. The lectures are focused on teoretical and systematical introduction into the problematics and on the key case law. Colloquium is oral. It is based on case study and 2 teoretical questions.
