Course objectives
This module will enable students to: • have knowledge of terminology and the functioning of insurance within private and public regulations • become familiar with the activities of insurance and reinsurance companies operating especially in the framework of insurance market in the territory of the Czech Republic • adopt principles for proper functioning of State supervision in insurance • adopt principles for functioning of the insurance company • acquire knowledge of insurance contracts both in interpreting them and drawing them up • adopt the principle of public, statutory and compulsory insurance After completion of the module the students should be able to: a) be familiar with the standard situations on the insurance market from the point of view of public and private law b) interpret and apply legal provisions from the sphere of insurance law and insurance c) know what to do in the sphere of social insurance, medical insurance, pension insurance and d) public health insurance in the Czech Republic
Syllabus
  • Contents • Insurance. Insurance, insurance and risk, development of insurance, contemporary insurance market, European law context. Reinsurance, tasks, importance, forms of reinsurance, origin and development of reinsurance. Insurance relationship and reinsurance relationship. System and classification of insurance. • Public Insurance Law. Concept, characteristic features, terminology, the right to run a business in insurance. State supervision in insurance, terms and conditions for carrying out insurance and reinsurance activities. Technical reserves, solvency, actuary in charge, accounting in insurance. Control activity of the Ministry of Finance in insurance. • Private Insurance Law. Concept, characteristic features, terminology. Policy of insurance. Origin, alteration and termination of private insurance. All risks insurance and an insurance of a sum of money. Private insurance of personal property and other property. Insurance of a person. • Legal regulation of activities carried out by insurance agents and insurance brokers. The right to get engaged in business activities as an insurance agent and insurance broker. The relationship between insurance company and an insurance broker and between a client and an insurance broker. Professional corporations. • Statutory and compulsory insurance. Implied insurance and the obligation under the law to participate in insurance. • Settlement of an insurance claim. Determination of an event insured against, the process of settlement, insurance fraud. • Public insurance. Legal regulation of medical insurance, pension insurance and social insurance. Public health insurance. • Pension scheme with allowance.

Range of Mode of Contacts: Lectures, use of commented presentations, group discussions, group seminar activities, brainstorming, case studies. Range of Other Learning Methods: Individual learning, self-study, elaboration of the written assignment, individual consultations.

Written comments with individual coursework assignments. Verbal feedback where required.
