Course objectives
The lecture aims to present model of criminal proceedings based on numerous sources in the literature. During the lecture, the traditional assumptions of the theory of the criminal process will be presented, which are growing in the current model of criminal proceedings in most civilized countries of the modern world. It also can relate to the principles of natural law and values. Additionally, assumptions of the practice to criminal procedural model also will be presented. Next part of the course will correspond to the presentation of new trends in criminal proceedings. The first issue to be analyzed concerns the conditions, procedures, and possibilities surrounding the collection of evidence electronically, taking into account the most recent relevant guidelines of the Council of Europe. The second issue to be examined will be the adaptation of criminal procedures, including Polish, to the standards stipulated in the Convention of the Council of Europe on Cybercrime of 23 November 2001, in light of national norms regarding evidence gathering. The third issue that will be assessed in this course will be the benefits, risks, or potential of the application of artificial intelligence algorithms in criminal procedure.
Learning outcomes
At the end of the course, students should be able to:
- understand and explain traditional theoretical assumptions for the current model of criminal proceedings and new trends in criminal proceedings, in particular in the field of electronic evidence, cybercrimes and artificial intelligence.
- work with information on model and new trends in criminal proceedings (documents of international organizations, e.g. the Council of Europe).
- create view, statements, essays on the model and new trends in criminal proceedings.
- make reasoned decisions about the rightness of the model of criminal proceedings and the use of new technologies in criminal proceedings, in particular in the field of electronic evidence, cybercrimes and artificial intelligence.
- make deductions based on acquired knowledge on the principles of the model of criminal procedure and new trends in this regard.
- interpret the benefits and risks of new trends in criminal proceedings.
Syllabus
  • 1. Presentation of theoretical assumptions of criminal proceedings model.
  • 2. Presentation of practice assumptions of criminal proceedings model.
  • 3. Presentation of criminal proceedings model determined according to statutory construction principles.
  • 4. Presentation of new trends in criminal proceedings (electronic evidence, cybercrimes and artificial intelligence).
  • 5. Reflection on the benefits and risks of modern technologies in criminal proceedings.
Teaching methods
Conducting an information and problem lecture combined - in some fields case study analysis. The case study method will be aimed at presenting practical issues of the functioning and organization of criminal proceedings.
