Course objectives
The course aims to strengthen the legal competencies of students by achieving the following objectives: Improve their ability to apply the law. Improve their capacity to interpret legal norms. Improve their ability to defend their legal positions. Improve their skills in critically analyzing academic texts. Improve their understanding of the relevance of EU law in the context of national law. All of this will be based on current labor law issues. Consequently, another key objective is to expand students' knowledge of labor law, including both its private and public law aspects. An additional goal is to improve their comprehension of private labor law norms within the broader context of private law. Thus, the course is designed to aid students in their development not only on a theoretical level but also in practical application. The emphasis is placed on working with monographs and EU regulations.
Learning outcomes
Students during the semester: Based on their selection, students will study a chosen monograph in detail. Their task is not only to read the book but also to: a) actively ask themselves questions while reading and search for answers (and record them), b) take notes on key ideas, c) record moments when they experienced an "aha" moment, d) formulate theses for academic debate, and e) note insights that can be utilized in their own dissertation work. With these prepared notes, students will attend at least one individual consultation with the instructor during the semester (ideally during the instructor's office hours). At the end of the semester (on November 28, 2024, at 3:00 PM), they will participate in a mandatory joint academic seminar with the instructor and other students of the course, where key aspects of the topics will be discussed. Students must bring a written detailed elaboration of a selected legal issue related to the studied publication to this meeting. They should be able to present the issue's solution and respond to feedback from others. The duration of the seminar will depend on the number of students enrolled in the course that semester. Students, working in pairs, will study selected employment law matters originating from the European Union. According to their own choice, they may select either: a) the legal regulation of whistleblowing, b) the legal regulation of work for digital platforms, c) the legal regulation of collective redundancies, d) the legal regulation of employer insolvency, e) the legal regulation of working hours and rest periods, f) the legal regulation of the right to disconnect, g) the legal regulation of on-call work, h) the legal regulation of the transfer of rights and obligations, or i) specific legal regulations in the area of anti-discrimination (employment) law. Other topics may be agreed upon with the instructor. The selected topic will a) be briefly introduced in a presentation at a joint meeting at the end of the semester. However, the key part of the presentation will be b) identifying a specific legal issue related to the de lege lata regulation and primarily c) presenting extensive arguments leading to its resolution.

  • The position of labour law in the legal system. Relationship to other branches of law. Comparative context and applicability of foreign literature and case law for the development of Czech labour law. Functions and principles of pre-employment law and their concrete manifestations. The possibility of applying the Civil Code to labour law relations. Participants in labour law relations, establishment of labour law relations, legal facts in labour law, invalidity of legal acts.

Teaching methods
Meeting with the instructor during the semester, meeting with peers at the final academic seminar. Professional dialogue, collective discussion – debate, working with text, presentation, responding to questions from the instructor and fellow students, home studying.
Assessment methods
To successfully complete the course, it is essential that students: During the individual consultation, demonstrate their thorough study of the selected publication. Questions will be asked about the read material, to which the student must respond. The student will also present their notes (as mentioned above) on the studied publication. The ability to formulate independent legal positions, whether in agreement or disagreement, will be evaluated. Additionally, students are required to actively participate in the final group seminar, engage in discussions, and demonstrate a deeper understanding of the selected subtopic of the monograph. For the presentation on a topic with an EU-related focus, adherence to the time limit (15 minutes), coherence in expression, and particularly accuracy in presenting the subject matter will be assessed. The ability to respond to questions from the audience and the capability to present detailed legal arguments for addressing the selected issue will also be evaluated.
