Course objectives
This module aims at developing understanding and awareness of the nature and history of IP protection, getting the overview of specific areas included in the legal regulation and getting specific knowledge of legal protecting of selected areas of IP related to business. The module will enable the students to: a) Develop an overall awareness of business related issues of IP b) Understanding the ethical context of IP c) Understand the nature of IP, range of implications and its impacts to business d) Understanding approach of CR and EU legislation to the IP issue in particular areas of industrial property and copyright e) Understand the procedural aspects of IP protection, IP litigation f) Develop understanding and ability to define appropriate measures and the set up the relevant g) system for IP protection in the company (in particular patents and trademarks). After completion of the module the students should be able to: a) identify the IP concepts and its specifics in the national, European and international environment b) choose appropriate techniques and apply relevant procedures to protect intellectual property in the business environment c) implement IP protection system in management of business organisation d) to set up relevant measures for protection of IP
Syllabus
  • The module addresses the following topics: a) IP concepts. Origin, historical survey and recent development of IP issue and its legal protection. Different IP law protection systems in the world. Ethical and legal issue. Constitutional fundaments of Czech IP law. b) Territorial limitation of IP rights. National, European and international dimension of IP protection. c) Industrial property I. Basics and Czech legislation. Protection of inventions through patents, international classification, patent claims, patent rights. Utility models, industrial designs, integrated circuits, plant varieties. Granting and registration procedure. Protected rights. d) Industrial property II. Basics and Czech legislation. Trademarks, legal protection of registered trademarks, conditions of protection, international classification. Geographical indications, appellations of origin, trade names. Registration procedure. Protected rights. e) Copyright and neighbouring rights. Basics and Czech legislation. Literary, artistic, audiovisual works, notions of performance, phonogram, radio and TV broadcasting etc. Databases and software protection. Protected rights. f) Legal protection of IP in business enterprises, trade secret, confidential information, know-how, innovation. g) Transfer of IP rights. Licensing and franchising h) Unfair competition relating to IP rights. i) IP litigation – proceedings before courts, arbitration, mediation j) Protection of IP rights in EU. European Patent Convention, Community patent. Community trademark. Community industrial design. Appellations of origin. Directives in the field of copyright, software, databases protection. k) International dimension of IP protection. International conventions administered by WIPO (Paris Convention, Berne Convention, Madrid Agreement). PCT system for patents. IP in international trade - TRIPS Agreement (public law level), Vienna Convention on Contracts on Sale of Goods (private law level). International organizations (WIPO, WTO, UNESCO).

Assessment methods
100 % written assignment Type and Weighting of Methods within Each Element: This module is assessed by means of a written assignment (2,000 to 3,000 words). Illustrative assignment and assessment criteria: 1. Identify the relevant IP issues in your organisation and design the appropriate measures for protection. 2. Draw a licence agreement between your organization and another company. An answer to those questions would be assessed against the following criteria: • complexity of analysed IP issues • critical evaluation and discussion of the main factors and their influence and likely impact on the organization identified with reasons. • logical conclusions with practical, achievable recommendations. Expected Form of Feedback: Formative and summative feedback will be provided to each student individually. Written comments with individual coursework assignments. Verbal feedback where required.
