Course objectives
The aim of the course is to extend the student's knowledge of EU law in the area of principles of its application in Member States (direct and indirect effect, primacy).
Learning outcomes
Student will be able to:
- understand the international and constitutional legal context of the principles of application of EU law in Member States
- apply EU law in the legal order of the Czech Republic
- understand the reaction of the Czech (and other) constitutional courts to the principles of application of EU law as they were formulated by the Court of Justice.
Syllabus
  • 1. The relation between international and domestic law, dualism and monism, legal philosophical bases and concepts
  • 2. TThe relation between international and domestic law on the one hand and EU law on the other hand
  • 3. The direct effect of EU law
  • 4. Direct effect of directives
  • 5. Indirect effect of directives, obligation of consistent interpretation in international law
  • 6. Primacy of EU law
  • 7. Primacy of EU law in Member States' constitutions (including the case law of Constitutional Courts)
