Course objectives
• Film law does not belong among the traditional and established legal branches such as, for example, constitutional law, civil law, commercial law and criminal law. Given term started to be used only when, in the beginning of the 20th century, there appeared broader public demand for new legislation regulating the new entertainment industry, and even then the term was used rather informally to refer to quite disparate sets of various legislation regulating the production and subsequent exploitation of film. Even today, this concept is not stabilized, however, mostly the norms of the copyright law, media law, advertising law, unfair competition law, personality rights and right to protection of freedom of speech – are usually considered to be part of this subject.
• The aim of the course is to present selected issues, which are dealt with within the film law, and to offer besides the basic historical and theoretical orientation in the subject also current information of a purely practical nature. The course focuses on the interpretation of the laws regulating the film primarily in the Czech Republic and in the United States. Besides this interpretation of the legal issues, there will be also discussed how, on the contrary, is the law reflected by film, what these two seemingly very different fields of human activity have in common and in what respect it still makes sense to legally regulate film in the 21st century.
Learning outcomes
Students will understand the mechanisms of audiovisual sector s regulation by law and its specificities in the Czech Republic.

  • Film, the right to freedom of expression and the right to protection of personality.
  • Film and legal regulation of media, including audio-visual advertising.
  • Regulation of film production, distribution, and audiovisual archival materials by public law.

Teacher's information
Ivan David (1985), attorney-at-law specializing in copyright and related legal fields. Graduated from the film studies at Faculty of Arts (Charles University) and from the Law Faculty (Charles University). Apart from his legal practice, since 2011 he has been teaching (as an external teacher) at, for example, FAMU, the Faculty of Philosophy of Masaryk University or the Faculty of Multimedia Communications at Tomáš Bata University in Zlín. At present (since 2020) he also works as a member of the FAMU Art Council. He is the author of the publication "Film law: Copyright perspective" (Nová Beseda 2015, supplemented and updated edition 2020) and author of articles dealing with the legal regulation of film. Since 2018 he has been consistently involved as a researcher in research projects investigating the impact of legal regulation on cultural industries in the Czech Republic
