Course objectives

The main goal of the course is to give students an idea about a field of law, that is generally neglected in standard studies, but offers broad application, not only for financial institutions, but also for attorneys and judiciary. The basis of the structure of the course will be a common administrative work of a company lawyer in private insurance company. The lessons will focus on practicality and interdisciplinarity, which will be evident in team composition of lecturers: apart from members of the academic staff, it will contain lawyers practicing the respective field. The course will deal with the topic of insurance law, which is, with respects to traditional division of legal branches, regulated in civil law, commercial law, and partially in administrative law. These will be the main topics: insurance contracts, different categories of insurance, arrangement of an insurance, supervision in insurance industry and specifics of the insurance in civil procedure. After successfully completing the course, the students should know law that is relevant for the work of company lawyers in an insurance companies, and be able to solve basic legal issues in that area. Selected successful students may be offered an internship in some insurance companies.

Learning outcomes

To be able to understand and explain main concepts, terms, principles and basic structure of insurance law. Student will be able to navigate through laws that regulate work of a lawyer in an insurance company. They should also be able to solve basic legal issues regarding insurance law.

Syllabus

• 1) Basic issues of insurance law, insurance contract, insurance of property and liability.
• 2) Personal insurance, consumer protection and personal data protection.
• 3) Property damage liability coverage in car insurance, liquidation of insurance events and procedural aspects of insurance legal claims, insurance fraud.
• 4) Rules of insurance distribution, supervision in insurance industry, corporate aspects of insurance company management.

Interactive teaching to communicate the information needed to solve practical examples. The main part of the course will be practical exercises, where practical and model cases dealing with legal issues in the field of insurance will be solved in the form of a discussion. Students prepare the solution of examples before the lesson. Teaching will take place in 4 three-hour blocks. The theoretical and practical part will always take place within the block. Teaching is supplemented by other forms of self-study - textbooks, syllabi and other electronic study materials (e-learning).

Assessment methods

The course will be completed by successfully attending a colloquium, which consists of discussion about selected issues of insurance law.

Course objectives (in Czech)

Cílem předmětu je přiblížit studentům oblast práva, která je v rámci běžného studia doposud opomíjena, nicméně v praxi nabízí široké uplatnění, a to nejenom z hlediska činnosti pro finanční instituce, ale též v rámci advokacie či soudnictví. Základním východiskem struktury kurzu bude běžná agenda firemního právníka komerční pojišťovny – důraz tak bude kladen na co největší praktičnost a interdisciplinaritu výuky. Tomu bude odpovídat i složení lektorského týmu, kdy kromě akademických pracovníků povedou kurz i právníci vykonávající praxi v dané oblasti. Kurz se bude zabývat problematikou pojišťovacího práva, které je z hlediska tradičního dělení právních odvětví ukotveno v občanském, obchodním a částečně i správním právu. Probrány budou především oblasti: pojistné smlouvy, jednotlivých kategorií pojištění, zprostředkování pojištění, dohled v pojišťovnictví a specifika pojištění z hlediska procesního práva. Po absolvování kurzu by studenti měli být schopni orientovat v právní úpravě, které je relevantní pro činnost firemních právníků v pojišťovně, a řešit základní právní problémy v této oblasti. Vybraným absolventům může být nabídnuta odborná praxe v některé z pojišťoven.

Teaching methods (in Czech)

Interaktivní výuka ke sdělení informací nutných pro řešení praktických příkladů. Stěžejní částí výuky budou praktická cvičení, kde budou řešeny formou diskuze praktické i modelové případy zabývající se právními otázkami z oblasti pojišťovnictví. Řešení příkladů si studenti připraví před výukou. Výuka bude probíhat ve 4 tříhodinových blocích. V rámci bloku proběhne vždy teoretická i praktická část.

Řešení příkladů si studenti připraví před výukou. Výuka bude probíhat ve 4 tříhodinových blocích. V rámci bloku proběhne vždy teoretická i praktická část.

Course objectives (in Czech)

Cílem předmětu je přiblížit studentům oblast práva, která je v rámci běžného studia doposud opomíjena, nicméně v praxi nabízí široké uplatnění, a to nejenom z hlediska činnosti pro finanční instituce, ale též v rámci advokacie či soudnictví. Základním východiskem struktury kurzu bude běžná agenda firemního právníka komerční pojišťovny – důraz tak bude kladen na co největší praktičnost a interdisciplinaritu výuky. Tomu bude odpovídat i složení lektorského týmu, kdy kromě akademických pracovníků povedou kurz i právníci vykonávající praxi v dané oblasti. Kurz se bude zabývat problematikou pojišťovacího práva, které je z hlediska tradičního dělení právních odvětví ukotveno v občanském, obchodním a částečně i správním právu. Probrány budou především oblasti: pojistné smlouvy, jednotlivých kategorií pojištění, zprostředkování pojištění, dohled v pojišťovnictví a specifika pojištění z hlediska procesního práva. Po absolvování kurzu by studenti měli být schopni orientovat v právní úpravě, které je relevantní pro činnost firemních právníků v pojišťovně, a řešit základní právní problémy v této oblasti. Vybraným absolventům může být nabídnuta odborná praxe v některé z pojišťoven.

• 2) Pojištění osob, ochrana spotřebitele a ochrana osobních údajů.
• 3) Pojištění odpovědnosti za škodu způsobenou provozem vozidla, likvidace pojistných událostí a procesně právní aspekty vymáhání práv z pojištění, pojistné podvody.
• 4) Právní úprava distribuce pojišťění, dohled v pojišťovnictví, korporační aspekty správy pojišťovny.
