Abstract
The paper briefly discusses, even against the background of some historical context, the state of the current Czech law, respectively the ongoing trends within it. At the same time critically evaluates the concept of recodification, which took place in the Czech Republic and which significantly influenced, among others, the economic base of the territorial self-governments. The latter applies particularly to a key recodification - the adoption of the new Civil Code. The mentioned recodification considerably complicated ( made more uncertain) the coexistence of private and public law, and so visibly weakened the regulatory ability of law as a whole. The paper therefore also pays attention to the possible conceptual solution to this unfortunate state of affairs.
