Abstract

This paper is focused on impact of adoption of the new Civil Code on legal consciousness of the Czech population. Paper first gives a brief overview of the recent understanding of legal consciousness as a projection of the legal issues to consciousness of social actors. It will then go on to possibilities and limits of the empirical investigation of the issue. The third part is concerned with the methodology used for this study including semi-structured interviewing. The fourth part presents the preliminary findings of the ongoing research. Finally, areas for further research are identified. The central question in this paper asks if and how adoption of the new Civil Code influenced legal consciousness in the Czech Republic. The main emphasis will be laid on results of qualitative research of legal consciousness regarding to the new Civil Code. The study offers some important insights into the issue of the Czech legal consciousness.

Abstract (in Czech)

Příspěvek je zaměřen na dopady přijetí NOZ na právní vědomí české populace. V jeho úvodu je představeno současné chápání právního vědomí jako projekce právní oblasti do vědomí sociálních subjektů. Poté se text orientuje na možnosti a meze empirického zkoumání dané problematiky. Další část příspěvku se zabývá technikou použitou v této studii, a to semi-strukturovaných rozhovorů. Poté autorky uvádí předběžné výsledky probíhajícího výzkumu. V závěru jsou identifikovány oblasti pro další výzkum. Ústřední otázkou tohoto příspěvku je, zda a jak se přijetí NOZ ovlivnilo právní vědomí v České republice. Hlavní důraz je kladen na výsledky kvalitativního výzkumu právního vědomí v kontextu NOZ. Studie přináší relevantní poznatky o problematice právního vědomí a civilní rekodifikace.
