Článek se zabývá hranicemi mezi dotvářením a přetvářením zákonného práva při soudním rozhodování. Na příkladech zákona o svobodném přístupu k informacím ukazuje, jak soudní judikatura může rozložit jednotlivá ustanovení zákona. V další části se článek zabývá kritikou soudní judikatury ve vybraných oblastech práva na informace.
In English
The article deals with the boundaries between the completing and tranformation od statutory law in the course of judicial decision-making. It shows on the example of the Act of the free access to documents how the judicial case-law is able to erode the individual provisions of the Act. In the following parts the article presents the criticism of the case-law dealinf with the different spheres of the right to information.
