Abstract

The conference speech was focused on evaluation of the main approaches to an ascertainment (liquidity) of a claim as a requirement for set-off and desription of their advantages as well as disadvantages. Special attention was paid to the legal regulation of set-off in the new Czech Civil Code.

Konferenční vystoupení bylo zaměřeno na zhodnocení hlavních přístupů k otázce zjištěnosti (určitosti) pohledávky jako předpokladu započtení a pojmenování jejich výhod i nevýhod. Zvláštní pozornost byla věnována právní pravě započtení v českém novém občanském zákoníku.
