Anotace

The contribution deal with different approaches to right to marry for same sex couples. With a little simplification family law stands on a recognition of legal relationships between adults – the marriage. The gender of persons which may enter into marriage are currently one of the most discussed topics. The aim of this contribution is to provide a general overview about existing approaches. If we focus just on the European trends, we may identify a vast diversity of approaches to the question of the same-sex couples on national levels: Marriage may be open to different-sex and same-sex couples equally; Marriage is reserved just for opposite sex couples, but same sex couples have a different option how to get their relationship legally recognized (civil unions, registered partnerships etc.); Marriage id reserved just for different-sex couples and does not provide any option for same sex couples for legal recognition of their relationship. The ways that can lead to opening marriage for all are legislative procedure, ruling of supreme or constitutional court, by referendum.
