Důležitou otázkou je zde posouzení nových právních skutečností, které se uskutečnili až po přijetí nového práva, avšak týkají se právních vztahů vzniklých za účinnosti staré právní úpravy. Článek kritizuje, že soudy nezohledňují základní principy, na nichž je intertemporální právo postaveno, zejména principy ochrany důvěry v právo. Namísto toho mechanicky posuzují téměř všechny nové skutečnosti, které se týkají starých právních vztahů podle předchozí právní úpravy. ER -
