Abstract

Kultúrne dedičstvo chránime vo verejnom záujme. Aby bol tento záujem naplnený, musí byť verejnosti umonení prístup k chráneným statkom. Prístup ku kultúrnemu bohatstvu je preto jedným zo základných práv. Cieľom príspevku je preskúmať, akým spôsobom by mal byť prístup zabezpečený a akým spôsobom reálne zabezpečovaný je. Pozornosť bude primárne venovaná prístupu k archeologickým nálezom, ako špecifickej skupine kultúrneho dedičstva, v Českej republike v porovnaní s ďalšími vybranými krajinami. Reflektované budú otázky vlastníckeho práva, miesta uloženia, starostlivosti o nálezy a samotné praktické umožnenie prístupu verejnosti.

Abstract (in English)

We protect cultural heritage in the public interest. In order for this interest to be fulfilled, the public must be given access to protected goods. Access to cultural heritage is therefore one of the fundamental rights. The aim of the paper is to examine how access should be granted and how it is actually granted. Attention will be paid to access to archaeological finds, as a specific group of cultural heritage, in the Czech Republic in comparison with other selected countries. The issues of ownership, place of storage, care of the finds and the actual practical access of the public will be reflected.
