Anotace

Dieses Werk bietet die erste Kommentierung des neuen österreichischen Pfandbriefgesetzes (PfandBG) und damit die erste umfassende Darstellung des österreichischen Pfandbriefwesens überhaupt. Das neue Pfandbriefgesetz trat im Juli 2022 in Österreich in Kraft und ersetzte die drei bisherigen Rahmenwerke – HypBG, PfandbriefG und FBSchVG. Das Pfandbriefgesetz soll im europäischen Rahmen einerseits eine stabile Refinanzierungsquelle für erschwingliche Hypothekar- und Kommunalkredite sowie andererseits eine sichere Anlageform ermöglichen.

This work offers the first commentary on the new Austrian Pfandbrief Act (PfandBG) and thus the first comprehensive presentation of the system. The new Pfandbrief Act came into force in Austria in July 2022 and replaced the three previous frameworks – HypBG, PfandbriefG and FBSchVG. In the European context, the Pfandbrief Act is intended to provide a stable source of refinancing for affordable mortgage and municipal loans on the one hand, and a secure form of investment on the other.
