Abstract

Ekonomická teorie posledních několika desítek let řeší způsoby, jak nastavit systém institucí a podnětů tak, aby jednání všech agentů ve společnosti bylo co nejefektivněji koordinováno. Stanovení pravidel regulujících vztahy mezi ekonomickými agenty je považováno za klíčovou podmínku společenské koordinace. Taková pravidla ale pozbývají svého významu, pokud nejsou vymáhána. Gary Becker a George Stigler navrhují řešení, které by mohlo k efektivitě vymáhání práva výrazně přispět. Gordon Tullock s řešením nesouhlasí. Cílem tohoto textu je analýza vzájemné argumentace a zodpovězení otázky, zda Beckerovo a Stiglerovo doporučení může přispět ke zlepšení vymáhání pravidel upravujících vztahy ve společnosti.

Abstract (in English)

The economic theory of the last decades deals with how certain models of institutions and incentives could improve the coordination of individual actions in society. Setting rules regulating relationships between economic agents is considered as the key requirement of such coordination. Nevertheless, the rule has no impact if it is not enforced. Gary Becker and George Stigler suggest a solution that could significantly contribute to efficiency in law enforcement. Gordon Tullock does not agree with their idea. The aim of the paper is to analyze their argumentations and to answer the question: "Is Beckers and Stiglers recommendation a good way to efficiency in law enforcement?"
