Abstract

práce popisuje právní problém komu patří vytěžená hlušina z hlediska vlastníka pozemku, na který je hlušina ukládána, těžebníka, který má právo těžit vyhrazený nerost a z hlediska vlastníka pozemku, na kterém je hlušina vytěžena. Srovnává se status hlušiny z hlediska zákona o odpadech a báňského zákona. Řeší se problém zda hlušina je věcí movitou či nemovitou.

Abstract (in English)

the work describes the legal problem who is the owner of the deadt - from point of view of the owner of the ground, on which the deadth is laid on, from point of view of the minor, who is entitled to mine the reserved minerals and from the point of view of the owner of the ground, from which the dead was mined out. The status of dead from point of view of Law about the waste and the Mining law is collated. The problem, wheather the deadth is movable or non-movable thing, is solved.
