Anotace

Local referendum is the most widespread and the most important form of direct democracy in the Czech Republic. Judicial review of local referendum is guaranteed by the Code of Administrative Justice. It is possible by a petition to the court to seek: determination that the proposal for holding a local referendum has no faults, announcement of a local referendum, declaration of the decision made in a local referendum being invalid or declaration of the vote made in a local referendum being invalid. The bodies competent to hear the petitions mentioned above are the regional courts (a cassation complaint in matters of a local referendum is inadmissible). This paper focuses on the judicial activity of the regional courts in relevant matters.
