The article deals with the adoption of Directive of the Council of Europe 2005/85/EC and its implementation into the legal orders of the Czech republic. This is one of the important steps in fulfilment of the idea of the Common European Asylum System. The Czech Republic had earlier stipulated in its legal order a majority of the standarts adopted in the Directive. The decision-making in asylum matters is entrusted to a body of state administration, i.e. the Ministry of the Interior, and an appeal against the decision is admissible in the form of an action lodged with regional court. This access to appeal against the decision is the main topic of the articla.
