Abstract

Studie se zabývá rozborem dvou souborů dokumentů: Kompaktát, která jsou mírovou smlouvou husitů s katolickou církví a Kapitulacemi, smlouvou mezi českou stavovskou obcí a králem Zikmundem (1436). V první části studie věnované Kompaktátům shrnuje průběh jednání mezi husity a basilejským koncilem a jeho legacemi ve střední Evropě. Jedná se na nich především o upřesnění formulací čtyř artykulů (článků), tvořících jádro Kompaktát a o jejich uvádění do církevní praxe. Je to bezprecedenční smlouva církve s Čechy a Moravany, dosud označovanými za kacíře, o jejich návratu do církve, aniž by se vzdali přijímání podobojí. Zikmund v Kapitulacích schválil téměř všechny požadované svobody stavů. Na základě těchto dokumentů měl být v Čechách a na Moravě obnoven nábožensko-politický „řád“ bez restaurace předrevolučního režimu. V závěrečné části autor uvažuje o významu těchto dokumentů v českých ústavních dějinách 15.–17. století, kdy české země směřovaly k ústavní stavovské a předparlamentní monarchii.

Abstract (in English)

The paper analyzing two collections of documents: Compacta or the peace treaty of the Hussites with the Catholic Church, and Capitulations, the contract of the Czech Estates with King Sigismund (1436). In the first part of the study devoted to Compacta he summarizes the dealings of the Hussites with the Council of Basle and the Councils legations to Central Europe. The focus of these negotiations was to specify the Four Articles, which form the core of Compacta, and their introduction into the liturgical practice. It is an unprecedented contract of the Church with the Bohemians and Moravians, until then depicted as heretics, describing their return into the Church without their giving up receiving both bread and wine during Communion. In Capitulations, Sigismund ratified almost all the requested Estate freedoms (svobody stavů). Based on these documents, the religious-political orde‘ was to be renewed in Bohemia and Moravia without the restoration of the pre-revolutionary regime.
