Abstract

Příspěvek je zaměřen na charakteristiku a komparaci některých dílčích otázek ochrany nájemce bytu v platném občanském právu a návrhu nového občanského zákoníku. Dotýká se zejména tradičních institutů občanského práva chránících nájemce bytu, zejména pak problematiky zániku nájmu bytu. Jeho cílem by mělo být zhodnocení dopadů navrhované právní úpravy na současné právní, ekonomické i sociální prostředí, v němž se nájemce bytu jako slabší strana smluvního vztahu pohybuje, a zaujetí stanoviska ke vhodnosti, účelnosti a kvalitě právní úpravy ochrany nájemce bytu v návrhu nového občanského zákoníku.

Abstract (in English)

The paper is focused on characterization and comparison of certain partial issues of the flat leasees protection in the czech civil law and in the draft of the new Czech Civil Code. It affects mainly the traditional institutions of the civil law protecting the flat leasee, especially the issue of the termination of the flat lease. Its aim should be to evaluate the impacts of the proposed legislation on current legal, economic and social environment which the flat leasee as the weaker part of the contract moves in, and gives opinion on the appropriateness, effectiveness and quality of the legal regulation of the protection of the flat leasee in the draft of the New Czech Civil Code.
