Anotace
Tato práce zkoumá, jak české soutěžní orgány pracují s judikaturou a hodnotově orientovanými úvahami Soudního dvora EU při posuzování přímého určení cen pro další prodej (RPM). S využitím rozhodnutí Super Bock analyzuje, jak jsou hodnoty na úrovni EU českými institucemi přijímány – či odmítány. Zjištění ukazují omezené kontextuální posuzování, přetrvávající formalismus a posun interpretační autority od Soudního dvora k domácím aktérům.
Abstract
This thesis examines how Czech competition authorities engage with the case law and value-based considerations of the Court of Justice of the EU in assessing resale price maintenance (RPM). Using Super Bock as a focal point, it analyses how EU‑level values are adopted – or resisted – by Czech institutions. The findings show limited contextual engagement, persistent formalism, and a shift of interpretive authority from the Court to domestic actors.

The thesis will analyse how the Czech Office for the Protection of Competition (ÚOHS), the Regional Court in Brno (KrS Brno), and the Czech Supreme Administrative Court (NSS) use the case law of the Court of Justice of the European Union (CJEU) in their decision-making in the area of competition law. The aim is to assess whether, and to what extent, the value-based considerations underlying the CJEU’s judgments are reflected or modified in the practice of the Czech authorities and courts.
The thesis will evaluate the national practice in light of the relationship between national and EU-level bodies, as well as the institutional and structural specificities of the Czech actors, for instance, their degree of specialisation in competition law or their capacity to interact directly with the CJEU through the preliminary reference procedure.
Methodologically, the thesis will be based on a detailed analysis of selected decisions issued by the ÚOHS, the Regional Court in Brno, and the Supreme Administrative Court. Where appropriate, this analysis may be supplemented by interviews with representatives of the relevant institutions.
