Anotace
Tato diplomová práce se zabývá principem země původu, klíčovým mechanismem podle čl. 3 směrnice o elektronickém obchodu, a to z regulatorního a praktického hlediska. Cílem práce je zachytit aktuální interpretaci principu země původu a analyzovat její transpozici a aplikaci v českém právním prostředí. Za tímto účelem práce rovněž porovnává transpozici a aplikaci v České republice s Rakouskem a Německem, přičemž zohledňuje odbornou literaturu a judikaturu Soudního dvora Evropské unie.

This thesis deals with the country of origin principle, a key mechanism under Art. 3 of the Directive on electronic commerce, from a regulatory and practical perspective. The thesis candidate will primarily focus on the examination and resolution of the following issues:

Analysis of the Country of Origin Principle from a legislative and regulatory perspective:
- Examination of how the Country of Origin Principle is implemented across different EU member states in the context of the Directive on electronic commerce.
- Detailed analysis of exemptions and derogations allowed under the Directive and their interpretation in national laws.

Analysis of the application of the Country of Origin Principle in case law:
- Focused study on significant cases from the Court of Justice of the European Union (CJEU) that have shaped the interpretation and application of the Country of Origin Principle.
- Evaluation of national court decisions impacting the implementation of the Principle in specific cases related to electronic commerce.
The thesis will culminate in conclusions that will highlight the results of the scientific analysis, including a summary of the key findings derived from the literature and case law selected by the thesis candidate.
Schedule for the processing of diploma theses:
May–October 2024: Search for and study of legislation, EU directives, and case law relevant to the Country of Origin Principle. Draft the outline of the thesis and discuss the approach and methodology with the thesis supervisor. Participation in a meeting of diploma candidates on October 11, 2024, to discuss the faculty's requirements and directives.
October - November 2024: Excerpting important cases and literature for detailed analysis. Draft a list of primary and secondary sources to be used, compile the introduction and table of contents, and submit these to the IS MUNI repository. Participate in the second meeting of diploma candidates on December 13, 2024, to defend the introduction and structure of the thesis.
December 2024 to January 2025: Continue to work on the detailed analysis of the Directive and its implementation. Submit the first comprehensive chapter focusing on legislative analysis to the repository by January 24, 2025.
February - March 2025: Complete the final analysis incorporating feedback from the thesis supervisor, focusing on case law and practical application issues. Ensure the work does not exceed 126,000 characters unless previously discussed with the supervisor.
The final version of the thesis must be submitted to the thesis supervisor either in person or electronically before it is bound and submitted. Follow the specific directives provided by the dean for final submission details.
