Prerequisites

After completing the course, the student should demonstrate a deep and detailed knowledge of the functioning of the system of the law of obligations, a comprehensive understanding of the basic concepts and institutes of the law of obligations, and should be able to distinguish and analyse in detail the differences between absolute and relative rights. In addition, he or she should demonstrate an advanced knowledge of the interrelationship between the general and specific parts of the law of obligations. In order to achieve this, the student must have previously successfully completed MP419Z Law of Obligations I, MP214Zk Civil Law - General Part and also MP311Zk Absolute Property Rights.

Course objectives
The aim of the course is mainly: -to characterize more broadly the contract, obligation, tort; -to know in more detail the basic types of ex contractu, ex delicto, ex quasidelicto obligations and to classify them in the system of (obligatory) law in the context of concurrent law (including commercial and labour law) - to know in detail the special part of the law of obligations governed by the Civil Code; - understand the differences between the various obligations and place them in the system of the law of obligations and understand the internal links and contexts; - to motivate students to comment on current trends in the development of civil law within the Czech Republic and changes that occur in the legislative and jurisprudential sphere; - to motivate students to be able to solve complex practical examples in a correct methodological way, while using the knowledge from previous courses taught in civil law.
Learning outcomes
At the end of the course and assuming the student has a detailed knowledge of the other parts of civil law, the student should also be able to: - Analyse and interpret key provisions of the Civil Code and principles of the law of obligations in order to effectively advise 'clients' or decide on the methodologically correct solution in specific legal situations; - critically evaluate and compare different interpretations of the law of obligations in the context of the development of case law and within the framework of general theoretical knowledge; - apply the norms of the law of obligations in a comprehensive manner in different contexts, e.g. when drafting contracts or resolving private law disputes; - assess the effects of legislative and case law changes in the field of contract law on legal practice; - identify and analyse contentious legal issues in the field of contract law and propose possible solutions taking into account relevant court decisions and the professional literature. This prepares the student for the practical application of his/her knowledge and skills in the field of contract law and should equip him/her to deal with complex legal problems and challenges that will arise in his/her professional life in the future.

Teaching methods
Teaching is carried out in the form of lectures and follow-up seminars. The lectures have a cognitive purpose, the seminars are aimed at practicing the ability to apply the acquired knowledge of de lege lata legislation to concrete situations. Direct teaching is supplemented by e-learning. The course has 6 credits. It is therefore assumed that the student will spend 180 hours of time studying it (1 credit = 30 study hours). Preparation for the exam is expected to take a minimum of 7 days (minimum 56 hours). The following weekly study load is expected during the semester: 2 hours lecture, 2 hours seminar, 6 hours seminar preparation.
Assessment methods
Compulsory seminar instruction, 2 continuous tests, ending with an exam containing practical examples. Continuous home preparation.

Teacher's information
The conditions for the end of the seminar teaching according to the requirements set by the lecturer in the seminar at the beginning of the teaching. A condition for admission to the examination for ISP is the preparation and submission of a seminar paper on a topic assigned individually by the ISP teacher (or other performance), as well as consultation of the material of the relevant semester at the dates set by the ISP teacher and within the scope of the teaching program. Otherwise, the relevant instruction of the Dean applies.
