Prerequisites
The student should have a basic idea of ​​the functioning of the legal order, the differences between private and public law, sources of law and their interpretation, as well as basic concepts and institutes of law. MP113Zk Teorie práva I

Course objectives
The aim of the course is: to define basic conception and notions, principles and sources of Czech Civil law; to place Civil law to the system of Private law; to orientate students in the general part (provisions) of the Czech Civil Code to characterize "persons and objects in a legal sense; to understand the concept of the juridical facts (and acts); to motivate students to express own opinions about the tendencies of development of the legal regulation Civil law in the Czech Republic; fundamental changes in the field of Civil law.
Learning outcomes
At the end of the course students should be able to: Understand and explain the fundamental concepts, principles and general framework of the private law and civil law as well as their importance within legal systems; Acquire basic professional knowledge, skills, and capabilities; Explain basic terms and institutions of the General part of Private (civil) law.
Syllabus
  • The conception and the function of the Private Law and Civil Law; The position of the Private Law in the general system of Law; System of Civil Law; Persons in a legal sense; Natural persons, statutory questions of family law; Protection of personal rights; Legal persons - general characteristics; System of legal persons of civil law (associations, foundations, institutions) Representation. The thing in the legal sense. Juridical facts (generally) Legal acts Time as a juridical fact, legal fictions, etc.

Teaching methods
Learning is made in the form of lectures and following seminaries. The lectures have a cognitive function, seminaries are reserved for the practice of the ability to apply the legal regulation on the concrete cases. E-learning added.
Assessment methods
Compulsory lessons, 2 tests, case law summary
Continuous home preparation.
Written test and oral part, the fulfillment of all obligations within the seminar teaching.

Teacher's information
Conditions for completing the seminar are according to the requirements set by the teacher in the seminar at the beginning of the semester. The condition for completing the seminar for ISP is the elaboration and submission of a seminar paper on a topic assigned individually by the ISP teacher and further consultation of the material of the relevant semester in the terms set by the ISP teacher and within the scope of the teaching program. In other cases, the relevant instruction of the Dean applies.
